Signing a Release & Waiver of Liability
Hello,
I am enrolling my 2.5 y.o. in a drop-off program at a pre-school/enrichment type facility for the first time starting next week...
Pretty standard forms and procedures upon enrolling including emergency contacts, medical info/allergies list, etc. But, then my husband came across the Release/Waiver of Liability form.
It included some pretty standard stuff such as offsite/field trip permission, sunscreen, medical release... which we were fine with.
It was the FIRST paragraph that we questioned....
essentially stating that we "waive and release and hold harmless" any employee, owner, officers, etc of the school of any liability, claims or causes of action arising out of any loss, damage, injury or even death sustained by the "participant", etc, etc.
Now, I understand we usually see these types of waivers when you enroll kids in gymnastics, sports related stuff, etc. But, a "preschool" or "daycare" facility? Now, of course I wouldn't expect the worst, especially when we as parents already do our diligence to research obsessively and thoroughly before choosing a facility and leaving our children there. I get that accidents can happen: falling on a playstructure, running or horseplay, etc. But, what about in the case of intentional neglect of a child or abuse for that matter. All the stuff we don't like to think about but try to not be naive about as well. CAn you really "waive" your right to seek action if god forbid the worst would happen???
Is this a pretty standard waiver signed at a school or child care facility? Any advice or thoughts would be greatly appreciated! thanks in advance!
